Terms of Service

These Terms of Service ("Terms") are an agreement between you (the "Client") and Pikes Peak Digital LLC ("Pikes Peak Digital," "we," "us"). By purchasing a plan or using our services, you agree to these Terms.

1. Services

We design, build, host, and maintain websites for businesses on a monthly subscription. We also offer a free website audit, delivered as a recorded video covering design, mobile usability, and search engine optimization (SEO), and, on request, a free demo website. The audit and demo site carry no obligation to purchase.

2. Plans and pricing

  • Basecamp: $149 per month, including 5 minor updates per month.
  • Ridgeline: $199 per month, including 10 minor updates per month and an online booking integration.
  • Summit: $349 per month, including 20 minor updates per month and an online ordering integration.

There is no setup fee. Third-party services connected to your site, such as booking or ordering platforms, may charge their own fees, which are your responsibility.

3. Term and renewal

Each plan has a minimum term of six (6) months. After the minimum term, your plan renews automatically month to month until cancelled. [confirm] If you cancel before the end of the minimum term, the remaining months of the minimum term are still due.

4. Billing

Payments are processed by Stripe. By starting a plan, you authorize us to charge your payment method each month on your billing date. If a payment fails and is not resolved within [confirm: 7] days, we may suspend your website until the balance is paid.

5. Build timeline

We aim to complete your website within three (3) business days of your first payment. Business days are Monday through Friday, excluding U.S. federal holidays. Delays caused by waiting on information, access, or approvals from you may extend the timeline.

6. Monthly updates

Your plan includes a set number of minor updates each month. Unused updates do not roll over. Minor updates include:

  • Contact information changes
  • Adding or removing individual menu items or products (each item counts as one update)
  • Photo gallery updates
  • Logo updates
  • Adding reviews

7. Additional work

Work outside minor updates is billed at $50 per hour. This includes adding new pages, color scheme or other major design changes, changes to the user interface (unless the current one is broken), and complete overhauls of products or menus. We will tell you before starting any billable work.

8. Content

You may provide photos, text, and other content for your website. If you do not, you authorize us to gather publicly available information about your business, including from Google, Yelp, and Facebook. You confirm that you have the right to use any content you provide, and we will remove or replace any content on request.

9. Ownership and buyout

While your plan is active, Pikes Peak Digital owns the website design and code and licenses it to you for use on your domain. Your logo, trademarks, and the content you provide remain yours. You may buy out your website at any time for a flat fee of $1,500. After the buyout is paid, ownership of the website design and code transfers to you, and we will provide your site files on request.

10. Cancellation

After the minimum term, you may cancel at any time before your next billing date. If you cancel without buying out your website, the website will be taken offline at the end of your final paid period.

11. Domain

Your domain name is registered in your name and belongs to you. We manage the domain for you while you are a client. When you leave, for any reason, we will help transfer management of the domain to you or your new provider.

12. Hosting and availability

We host your website with a reputable third-party provider and work to keep it online and secure, but we cannot guarantee uninterrupted availability.

13. Limitation of liability

To the extent allowed by law, Pikes Peak Digital is not liable for indirect, incidental, or consequential damages, including lost profits. Our total liability for any claim is limited to the amount you paid us in the three (3) months before the claim.

14. Governing law

These Terms are governed by the laws of the State of Colorado. Any dispute will be handled in the state courts located in Teller County, Colorado.

15. Changes

We may update these Terms. We will notify active clients of material changes at least 30 days before they take effect.
